Agreement and accounts
By creating an account or using Vital, you agree to these terms and to our Privacy Policy. Vital is provided by Ogimi Labs, Inc. (“we”, “us”). If you don’t agree, please don’t use Vital.
Age: you must be at least 13. If you are under the age of majority where you live, a parent or guardian must agree to these terms for you.
Your account: give accurate information, keep your password private, and tell us if you think someone else is using your account. You are responsible for activity on your account.
Your name on the leaderboard: the name you choose may be shown to other Vital users. Don’t use a name that is offensive or impersonates someone.
Deleting your account: you can delete it at any time in the app (Profile → Delete Account).
Subscriptions, trials and refunds
Some Vital features need a paid subscription. The price, billing period and any free trial are shown before you buy.
If you subscribed in the iPhone app (Apple):
Apple bills you, under Apple’s terms.
Your subscription renews automatically at the end of each period unless you cancel at least 24 hours before it ends. A free trial turns into a paid subscription the same way.
To cancel: iPhone Settings → your name → Subscriptions.
Refunds are requested from Apple at reportaproblem.apple.com.
If you subscribed on the web (app.joinvital.ai):
Stripe bills you, on our behalf.
Your subscription renews automatically at the end of each period unless you cancel before the renewal date. A free trial turns into a paid subscription when it ends unless you cancel before then.
To cancel: email support@joinvital.ai or use the link in your receipt.
Refunds: email us; we handle requests case by case and as the law requires.
In both cases:
Cancelling stops future renewals; you keep access until the end of the period you paid for.
Deleting your account does not cancel a subscription. Cancel it first.
Price changes: we will tell you before a new price applies, and you can cancel before it does.
A subscription bought in one place (Apple or web) may not be recognized in the other yet. If that happens, contact us and we’ll sort it out.
AI-generated meditations
Vital uses artificial intelligence to write each meditation from the topic you give it, and AI voices to read it aloud. AI can make mistakes: a meditation may be inaccurate, off-topic or not to your taste. Use your own judgment, and stop any practice that makes you uncomfortable.
Vital is not medical or mental-health care. Meditations are for general wellbeing. They don’t diagnose or treat any condition, and they don’t replace a doctor, therapist or other professional. If you are in crisis or thinking about harming yourself, contact local emergency services or a crisis line (in the US, call or text 988).
Use Vital safely. Don’t listen to meditations while driving, operating machinery, or anywhere you need to stay alert.
Acceptable use
You agree not to:
ask Vital to create content that is illegal, sexual, hateful, harassing, or that encourages self-harm or violence
try to get around safety measures, or use Vital to produce content for others at scale
copy, resell or redistribute Vital’s meditations or voices commercially without our written permission
interfere with the service, reverse-engineer it, or access it with automated tools except as we allow
use another person’s account or impersonate anyone
We may refuse requests, remove content, or suspend accounts that break these rules.
Your content and ours
What you type stays yours. You give us permission to use your topics and settings to create, store and replay your meditations and to run and improve Vital, as described in the Privacy Policy.
Your meditations: you may listen to, save and replay the meditations Vital makes for you for your own personal use.
Vital itself — the app, voices, music, designs, text and the Vital name — belongs to Ogimi Labs, Inc. or its licensors. We give you a personal, non-transferable license to use the app while these terms apply. On iPhone, Apple’s standard license agreement also applies.
Feedback: if you send us ideas or suggestions, we may use them without owing you anything.
Disclaimers
Vital is provided “as is” and “as available”. To the extent the law allows, we make no promises that it will be uninterrupted, error-free, or suited to a particular purpose. Nothing in these terms limits rights you have under consumer-protection laws that can’t be waived.
Limitation of liability
To the extent the law allows, Ogimi Labs, Inc. is not liable for indirect, incidental, special or consequential damages, or for lost profits or data. Our total liability for any claim about Vital is limited to the greater of the amount you paid us in the 12 months before the claim, or US$50. Some places don’t allow these limits, so they may not apply to you.
Ending these terms
You can stop using Vital and delete your account at any time. We may suspend or end your access if you break these terms or if we stop offering Vital; if we stop offering it, we will give reasonable notice where we can. Sections that by their nature should survive (such as ownership, disclaimers and liability limits) continue after these terms end.
Governing law
These terms are governed by the laws of the State of Delaware, USA, without regard to its conflict-of-law rules, except where the law where you live requires otherwise.
We may update these terms. We will post the new version on this page with a new effective date and, if a change is significant, tell you in the app or by email before it applies. Continuing to use Vital after that means you accept the new terms.
